Expunge or Seal: Creating Options for Your Future

Trying to lease an apartment, or apply for a new job, and that troublesome arrest record keeps showing up? If you have not been convicted (adjudicated guilty) in a case, you may have some options, such as the Expunging or Sealing of your record. Florida Law has made provisions that an arrest record may be expunged (records destroyed) if the case is dropped or dismissed. To qualify for an Expunction, you must never have been convicted of a crime in the past. A Sealing is different in that it only seals the arrest records (does not destroy them) and in the case of a Sealing of your records, again, you cannot be convicted or found guilty of the crime. However, if the case ended in a result of “withholding adjudication” you may qualify for a Sealing of that record. The steps to obtain a Sealing are very similar to requesting an Expunction. You still must not have been convicted of any crime in the past, and you must make application to the Florida Department of Law Enforcement and upon approval, Petition the Courts, and have an Order entered.
